All such rights are reserved.

      The trade marks, logos, and service marks displayed on the websites (collectively, the “trade marks”) are the registered and unregistered marks of NetPay, our licensors or our partners in the UK and other countries, and are protected by UK and international trade mark laws. Any other intellectual property rights not owned by us, our affiliates, our partners or our licensors that may appear on the websites are the property of their respective owners who may or may not be affiliated with or connected to us. All such rights are reserved.

      Notwithstanding the provision of section 1 (disclaimer) above, you agree that in using the websites, to the fullest extent permitted by the laws of England and Wales, NetPay’s maximum aggregate liability shall not exceed fifty pounds Sterling (£50.00) and NetPay shall not be responsible or liable for any direct, indirect, special, incidental, or consequential damages of any kind, related to the websites regardless of the form of action whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages, for any:

      3. data non-delivery, mis-delivery, corruption, destruction or other modification; or

      No failure to exercise and no delay on the part of either party in exercising any right, remedy, power or privilege of that party under these terms and conditions and no course of dealing between the parties shall be construed or operate as a waiver thereof, nor shall any single or partial exercise of any right, remedy, power or privilege preclude any other or further exercise thereof or the exercise of any other right, remedy, power or privilege. The rights and remedies provided by these terms and conditions are cumulative and are not exclusive of any rights or remedies provided by law. Time shall not be of the essence of these terms and conditions as regards any of the times, dates and/or periods mentioned herein.
